Why must lawsuits be filed within a certain amount of time?
A lawsuit must be filed within the statute of limitations for a number of reasons. The first reason is to prevent a potential lawsuit from lingering over the doctor who caused the error. Another reason that statutes of limitations have been enacted is to help to prevent the decay of witness’ memories. As time goes by, the memories of those who witnessed the error diminish. This means that the longer it takes to depose the witness, the higher the chance that he or she will have forgotten details of events surrounding the error.
