What is the difference between negligence and a mistake?
The difference between negligence and a mistake is frequently very slim. Most of the time, the difference
comes down to the judgment call of the doctors involved as well as what the duty was to the patient.
If the duty was breached by the mistake in question, then it is likely a case of negligence. If the
duty to the patient was not breached, then the mistake may not amount to negligence.
