Are doctors held to higher standards than other people for breach of duty?
Yes. Because doctors have received a higher level of training and education in treating illnesses and helping people, they are held to a higher standard than the very basic “reasonable person” standard. In addition, doctors in large urban areas with lots of access to continuing education or the latest technologies and practices may be held to higher standards than their very rural counterparts.
