A recent study published in the New England Journal of Medicine estimates that about 1 in every 5 medical injury claims are paid out.

Researchers analyzed the malpractice insurance coverage held by about 41,00o doctors between 1991 and 2005.  They found that about 1 in every 14 doctors is sued for medical negligence every year.

Furthermore, the study says that neurosurgeons and heart surgeons are the most likely to have a medical injury claim filed against them.  About 19 percent of neurologists and cardiologists are sued every year for medical malpractice.

Psychiatrists and pediatricians were the least likely to be sued for medical malpractice.  However, medical injury claims filed against pediatricians resulted in the highest pay outs at an average of $520,000 per claim.  Paid claims made against other physicians averaged $275,000.
