<p style="font: normal normal normal 12px/normal Helvetica; margin: 0px">The Supreme Court upheld policyholders&#39; claim that they had a constitutionally protected, contractual right to the money. The state asked the court to rehear the case, claiming the court disregarded facts, expanded definitions of vested rights to apply to policy holders and improperly shifted the burden of proof to the state.</p>

<p style="font: normal normal normal 12px/normal Helvetica; margin: 0px">The court refused to rehear the case and said the state could not change law to apply retroactively to the contracts and take the surplus.</p>

<p style="font: normal normal normal 12px/normal Helvetica; margin: 0px">A Northampton County Court jury returned a verdict Friday in the case of 71-year-old Pauline Raffaele. Rafaele was admitted to EAston Hospital on June 21, 2005 for a replacement of her left arthritic knee. The day after the surgery Raffaele complained of numbness in her left foot, which she was unable to move. By 3:00 p.m. that day, a rehabilitation doctor was consulted and found that Rafaele&#39;s leg was white, and she had no feeling in it. Emergency surgery later revealed an undiagnosed blood clot in the toot.</p>

<p style="font: normal normal normal 12px/normal Helvetica; margin: 0px">A month later, doctors had to amputate her leg below the knee. A short while later, doctors were forced to remove more of&nbsp; her leg, above the knee.&nbsp;</p>

<p style="font: normal normal normal 12px/normal Helvetica; margin: 0px">The jury found the hospital to be 40 percent negligent, and a former nurse named Shelly Benson, to be 60 percent negligent. Benson did not alert doctors to Rafaele&#39;s deteriorating condition.</p>

<p style="font: normal normal normal 12px/normal Helvetica; margin: 0px">Herta Hopton claimed that oral surgeon Warren Vallerand failed to diagnose cancer in her mouth despite repeated visits. Jurors awarded more than $15 million against Vallerand and the Center for Oral &amp; Facial Surgery. The verdict is the largest dental malpractice award in United States history.&nbsp;</p>

<p class="MsoNormal">Christus Health Southeast Texas Hospital has been ordered topay $1.4 Million to a woman whose daughter died of a heart attack afterreceiving treatment at the facility.</p>
<p class="MsoNormal">Mary Ann Licatino filed a medical malpractice suit againstthe hospital after her daughter Stacy Meaux died of a heart attack a day afterreceiving treatment at Christus. Licatino alleges that Meaux&rsquo;s death was causedby an incorrect diagnosis by the attending physician, Dr. Michael Peterson, andnegligent treatment by the hospital&rsquo;s nursing staff.</p>
<p class="MsoNormal">Peterson settled the case against him out of court, whilethe hospital took the case to civil trial. A jury found that Christus nurses failedto adequately treat Meaux, contributing directly to her death from cardiacarrest.</p>

A 60-year-old woman was overadiated 17 times and which caused the perforation of her bowel and her death.

In 2003, the woman was diagnosed with stage-three endometrial cancer and began raditation right after. The first 11 treatments went fine. Then the woman was overadiated 17 times. She received 270 centigrays instead of 180 centigrays. Her husband sued for medical negligence and he claimed that the hospital was negligent by not looking at her charts and catching their overadiation mistake. The overadiation caused the perforation of her bowel that caused a bacterial infection in her blood and her death.

A 63-year-old man died in the ER Saturday after waiting nearly and hour to be helped. This issue is raising serious questions.

Police<br />
records reveal the man walked into the emergency room of Aria Health<br />
Frankford Hospital complaining with a pain in his torso, where he was<br />
told to take a seat. Police say that the final moments after his death, his<br />
wrist watch was stolen.
</p>

<p class="MsoNormal">A 31-year-old man from England has died after receiving cancerous lungs in a transplant operation. Matthew Millington mistakenly received the organs from a donor who is believed to have smoked between 30 and 50 cigarettes a day.</p>
<p class="MsoNormal">Steven Tsui, clinical director of transplant services at the Papworth Hospital in Cambridge, told the North Stafford Coroner&rsquo;s Court &ldquo;there were a number of failures. I didn&rsquo;t feel the team performed to the standard I would expect.&rdquo;</p>
<p class="MsoNormal">A lack of communication between radiographers and consultants caused a tumor to go two years without being detected. It&rsquo;s growth was accelerated by the immunosuppressive drugs Millington was taking to prevent his body from rejecting the organ. </p>
