Opthamologist Settles with NJ Woman for $1.2 Million in Malpractice Lawsuit

Posted on December 28th, 2009 No Comments

A New Jersey woman who lost the use of one eye due to a misdirected anesthesia needle received a $1.2 million dollar settlement from the opthamologist and anesthesia team responsible for her injury. The medical malpractice case was settled out-of-court and was paid for by the opthamologist's insurance and the team responsible for administering the anesthesia prior to surgery.

Because it was determined that the woman's vision-loss was the direct result of complications that arose after she received the anesthesia shot, she was able to pursue legal action against the medical professionals responsible for the injury.

The parents of a three year-old Pennsylvania boy were awarded $15 million after a Suffolk County jury found two doctors guilty of medical malpractice. The boy died in December of 2004 after undergoing a procedure to correct a birth defect at the Children's Hospital of Boston.

After four days of deliberation, the jury decided that the doctors were responsible for the death. Sources say that the parties reached a financial agreement prior to the verdict, so the actual award will be less than that set by the jury.

Medical Malpractice Reform Exaggerated

Posted on December 17th, 2009 No Comments

The recent healthcare debate has caused many individuals to support their sides with information and data.  One of the most commonly used attacks on healthcare costs is that if medical malpractice reform occurred healthcare costs would be dramatically lower.  This type of statement is dishonest at best.

Medical malpractice suits are important because it keeps the healthcare industry in check and can provide compensation when serious medical mistakes occur.  Medical malpractice reform would be a drop in the bucket to the overall costs of healthcare in the United States, and if suits were limited the patient would suffer in the end.

Medical malpractice suits are important because it holds doctors and hospitals accountable for mistakes that could result in serious physical injury or death.  These suits provide a powerful incentive to constantly provide the best amount of care and keep doctors from making careless mistakes.

Posted on December 10th, 2009 3 Comments

A new study shows that surgeons who are exhausted are morelikely to say they had recently committed a major error on the job.

The study, conducted by Johns Hopkins University School ofMedicine, is the largest study to date on physician fatigue. Charles M. Balch,M.D., one of the study’s leaders, said of the findings “people have talked aboutfatigue and long working hours, but our results indicate that the dominantcontributors to self-reported medical errors are burnout and depression… All ofus need to take this into account to a greater degree than in the past.Frankly, burnout and depression hadn’t been on everybody’s radar screen.”

Out of the 7,905 surgeons who responded to the study, ninepercent reported having made a major medical mistake in the previous threemonths. Forty percent of the surgeons surveyed described themselves as “burnedout.”
