Washington Supreme Court Deems Malpractice ‘Hurdle’ Unconstitutional

The Washington State Supreme court made it easier to sue for medical malpractice on Thursday. The court has done away with a state law that required people who want to sue for malpractice produce a certificate of merit signed by a doctor.

In a ruling issued Thursday, seven of nine justices found that the requirement “unduly burdens theright of access to courts” which violates the separation of powers clause in the constitution. The law was originally designed to weed out frivolous lawsuits against medical care providers.

LA County Expected to Settle UCLA Malpractice Suit

Los Angeles County is expected to approve a $305,000 settlement in a medical malpractice suit Tuesday. The suit was filed by the family of a man who died at County Harbor-UCLA Medical Center. The lawsuit alleged that physicians failed to properly intubate the patient before performing a diagnostic procedure intended to save his life.

Under the terms of the settlement, the county will not admit any liability or wrongdoing in the death of the man, Jose Hurtado, a father in his late 40’s who suffered fractures and internal injuries after a paragliding accident in Rancho Palos Verdes.

The Los Angeles County Claims Board has already approved the settlement. The Los Angeles County Board of Supervisors will decide on the matter today.

Anesthesia Malpractice Suit Filed Over Florida Teens Death

The family of a Florida girl who died from an anesthesia complication has filed a medical malpractice suit against the plastic surgeon and anesthesiologist who performed the out-patient procedure.

According to the lawsuit filed in Palm Beach County, by the family of 18-year-old Stephanie Kuleba, the plastic surgeon and anesthesiologist failed to meet acceptable medicalstandards when Kuleba suffered a potentially fatal reaction to anesthesia during corrective breast surgery in March 2008.

The lawsuit alleges that doctor Steven Schuster and anesthesiologist Peter Warheit failed to recognize the symptoms of malignant hyperthermia and failed to administer the proper treatment to save Kuleba’s life.

Family Sues Over Breast Surgery Death

A family of a young girl has brought charges against the operating plastic surgeon and anesthesiologist following the young girls death following an operating.

According to reports,  the girl was undergoing corrective plastic surgery when she began to have complications from the anesthesia.  The girl was rushed to a hospital where she would later die at.  Family members of the girl have brought suit stating that the doctors could have saved her life by acting earlier.  If the doctors were better trained they would have noticed initial signs of the complications and possibly been able to stop the girl from losing her life.

Malpractice Claims Reach Low in Missouri

In Missouri, medical malpractice claims have reached a record low. At the end of 2008, there were just over 3,000 medical malpractice cases pending against doctors, hospitals and health care providers.

According to a spokesman from the Insurance Department, that is the lowest number of pending cases in the last three decades. This is likely influenced by a 2005 law restricting these cases.

Montgomery County Malpractice Cases Spike

In 2004, legislation was passed in Pennsylvania mandating that medical malpractice cases be filed in the county where the act took place. In the years since, this has meant a spike in malpractice cases for Montgomery County and a huge decrease in cases for Philadelphia.

In Montgomery County, where the average number of malpractice cases before 2004 was 20, there has been a 300% increase. In 2008, there were 58 malpractice cases, making Montgomery the county with the third largest amount of malpractice cases in the state.

Malpractice Payouts on the Decline

According to Public Citizen, medical malpractice payouts have declined for the third year in a row. In 2008, there were a recorded 11,037 payments made to medical malpractice victims, 31% lower than the average of all previous years.

Unfortunately, the decline in malpractice payouts does not mean that medical malpractice itself is on the decline. Instead, it means that victims of medical malpractice are increasingly not getting the restitution they deserve.
