Las Vegas Doctor Will Face Charges

Dr Dipak Desai ran two endoscopy clinics in Las Vegas that were linked to a Hepatitis C outbreak. There have been 9 confirmed cases of patients contracting Hepatitis C from the clinics, and another 105 cases may be linked as well.

However, Dr Desai recently suffered a stroke that could have left him unable to stand trial. In a recent assessment by a neuropsychologist, the doctor has been cleared as medically competent to defend himself.

Family Awarded $749K in Malpractice Case

In Jackson Mississippi, a World War II veteran underwent eye surgery to remove a flap of skin from between his eyebrow and eyelid. A solution used in his surgery preparation burned his corneas and caused severe pain and vision loss.

The man became care dependent and his family sued on his behalf. A US District Judge awarded the family $249,000 in economic damages and $500,000 in other damages. The man died after the trial ended but before the verdict was returned.

Maryland’s Informed Consent

On April 28, 1995, Peggy McQuitty had an ultrasound that showed an abnormality. She was not told that an immediate C section could result in the birth of a healthy child. Instead, her son was born 10 days later with cerebral palsy because of a uterine abruption.

In September 2001, McQuitty sued for lack of informed consent. However, the court and the Court of Special Appeals ruled that a doctor's inaction was not a form of malpractice. The high court, however, reversed the decision, expanding informed consent doctrine in the state.

Medical Malpractice Payouts Fall

Public Citizen has reported that medical malpractice payments fell across the country in 2008. There were 31% fewer payouts last year than the yearly average of all preceding years.

Unfortuantely, while payouts have been in decline, medical malpractice has not. Instead of medical care becoming safer, fewer victims are receiving the compensation they deserve.

Navy Hospital Malpractice Case Settled

In 2005, Kendra Alcorn gave birth to twins at Jacksonville Naval Hospital. In the high risk pregnancy, the first child was born healthy but the second suffered oxygen deprivation. As a result, he developed cerebral palsy and went blind.

The boy died about three years later on September 27, 2008 and the parents filed a malpractice suit as a result. Recently, the parents' medical malpractice suit against the hospital was settled for $500,000.

Woman Awarded $60M for Medical Malpractice

In Great Neck, New York, a Bronx woman has been awarded $60 million in a medical malpractice suit. The suit was brought against a plastic surgeon who performed a thigh lift procedure on the woman.

The doctor failed to warn her of the risks involved, and caused irreparable damage to the woman's labia. The doctor was found to have deviated from acceptable medical practices in the surgery as well.

$3M Verdict in Radiology Malpractice

In January 2000, a woman had surgery to remove a cyst from her ovaries, causing a bowel leak. After the surgery, radiologists either missed or failed to report the leak in her bowels.

For further imaging, the woman was prescribed barium which leaked into her intestines, causing chemical and bacterial peritonitis. She had to undergo several surgeries as a result. She filed a law suit in 2000, but it was delayed for several years. She was finally awarded $2.978 million by a jury last month.

WI Supreme Court Disallows Malpractice Case

On July 24, 2003, a Wisconsin man had surgery to repair an ulcer. A sponge was left in his body after the surgery and was not retrieved until August 8 that year. He died three days later.

On August 8, 2006, the man's estate sued the hospital and doctors for medical negligence and his widow sued for wrongful death. Unfortunately, the Wisconsin Supreme Court ruled that both suits were outside the 3 year statute of limitations because the injury occurred July 24.
