The Indiana Court of Appeals recently reversed the decision of a lesser court to disallow a medical malpractice trial. The case will now be brought to court by the parents of a girl born in 2002.
The suit alleges that the doctor on the case told the parents that he was going to use a vacuum to help the girl's birth along. However, he did not explain the risks. The girl now suffers from a seizure disorder brought on by her birth injure.
