There is a new trend in surgeries of all types to have surgery in a private hospital and then recuperate in a spa-like setting. This trend is common particularly for individuals who have undergone a significant surgery and will require a few weeks to get back on their feet. The problem is that many feel that the spa-like recovery areas are actual medical facilities.
The first problem with any recovery retreat is that these retreats frequently do not have a full medical staff. They may have a few nurses and medical technicians on staff but will lack someone to be in charge if something serious goes wrong. This is usually not a problem since recovery would generally be done at home without constant care by a doctor or anyone with medical training but it still could lull people into a false sense of security.
Another problem arises in the event of a medication or other medical error on the part of the recovery spa. If a person messes up his or her own pain medication in their own house, it is difficult to argue that the doctor messed up. If the nurses or medical technicians of the retreat mess up and hand out the wrong prescription, where do they stand legally?
They are supposedly bed and breakfasts designed to assist their patients through the first bit of recovery, not necessarily to provide medical care. This grey area could be a problem in the event of a medication error or something similar, particularly as many attest to not being medical facilities.
